COPYRIGHT

When dealing with remixed music there are some issues within current copyright law. One area is the fact that remixes are derivative works meaning they take other artists songs and all music released for consumers has copyright protection, requiring the permission of the original artist first.

To follow the legal procedure, you must buy a copy of the song and then obtain permission from the copyright holder. There will be copyrights for the song and for the master recording and you need permission from both copyright holders to legally remix a copyright protected song. The last step is to make a record of permission that requires a written account that you have been granted permission from the copyright holder. 

After this the remix, still can't be played unless there is registration with the performance rights society to be able to play the remix in a place of business or where there is money being made from the remix. For people making remixes for fun these problems are not a worry but when the remix enters commercial success, copyright permission is required.

All trademarks, logos, trade dress and service marks on the Sites are either trademarks or registered trademarks of Indaba and may not be copied, imitated, or used, in whole or in part, without the prior written consent of Indaba. Notwithstanding the foregoing, the Converse Rubber Tracks Sample Library logo which appears on the Sample Library Site is the sole property of Converse, Inc. and may not be copied, imitated, or used, in whole or in part, without the prior written consent of Converse, Inc.

 

GRANT OF RIGHTS: By entering this Contest, Entrants assign away and transfer (as set forth below) any and all rights in the Submissions on a worldwide, perpetual, irrevocable and royalty-free basis, for any and all purposes including, but not limited to, display, public performance, posting for streaming and/or download, making of derivative works, reproduction, distribution, and all other means of exploitation of the Submissions. Entrants agree that the Artist, or a designee of Artist, shall, from inception, own all right, title and interest in each Submission (including, but not limited to, the copyrights in the sound recording) in perpetuity, free from any claims by Entrant or any other person and all such works shall be deemed "works made for hire" for the Artist or such designee. Entrants shall have no ownership rights or interest whatsoever in the applicable Submission, and shall not commercially use or exploit the Submission in any manner whatsoever. Entrant is permitted to use the Audio Assets solely for the creation of Submission Materials and Submissions and participation in this Contest. Notwithstanding anything to the contrary above, as between Entrant and the Artist, or a designee of Artist, each of the Entrants shall own the rights to the original elements of such Remixes as are created by that Entrant, when such original elements are separated from the Audio Assets and so long as such original elements do not infringe the Contest Parties rights in the Audio Assets.

BY ENTERING A SUBMISSION, ENTRANTS ACKNOWLEDGE THAT SUBMISSIONS MAY BE POSTED ON OPERATOR’S WEBSITE, IN OPERATOR’S DISCRETION. Operator reserves the right to, and may or may not, monitor/screen Submissions prior to posting them to the Website. Entrants acknowledge that Operator has no obligation to use or post any Submissions. By submitting a Submission, Entrants warrant and represent that: (a) the Submission is Entrant’s original work; (b) the Submission has not been previously published; (c) the Submission has not previously received awards; (d) the Submission does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity; (e) Entrant has obtained permission from any person whose name, voice or performance is used in the Submission; and (f) exploitation, use, display or performance of the Submission via any form of media, will not infringe the rights of any third parties. Entrants shall indemnify and hold harmless, Operator and Contest Parties from any claims contrary to or in violation of these warranties and representations.
